1. DEFINITIES, REIKWIJDTE EN JURIDISCHE POSITIE

Dit cookiebeleid beschrijft op juridisch uitputtende en defensieve wijze hoe Resqueu gebruikmaakt van cookies en daarmee vergelijkbare technologieën binnen alle digitale omgevingen van Resqueu, waaronder begrepen maar niet beperkt tot de mobiele applicatie, websites, webviews, servers en gekoppelde systemen.

Dit cookiebeleid is van toepassing op alle gebruikers van het Platform, waaronder consumenten, ondernemingen, medewerkers van ondernemingen en overige betrokkenen.

Dit cookiebeleid vormt een zelfstandige informatievoorziening op grond van de Telecommunicatiewet, de Algemene Verordening Gegevensbescherming (AVG) en aanverwante regelgeving, en dient te worden gelezen in samenhang met de Privacyverklaring, servicevoorwaarden en EULA van Resqueu. Bij tegenstrijdigheid prevaleren de servicevoorwaarden.

Gebruik van het Platform impliceert kennisname van dit cookiebeleid en, voor zover wettelijk vereist, het verlenen van toestemming voor het plaatsen en uitlezen van cookies en vergelijkbare technologieën.

2. WAT ZIJN COOKIES EN VERGELIJKBARE TECHNOLOGIEËN

Cookies zijn kleine tekstbestanden die bij het bezoeken van een website of het gebruik van een applicatie op het apparaat van de gebruiker worden geplaatst of uitgelezen.

Naast cookies maakt Resqueu gebruik van vergelijkbare technologieën, waaronder maar niet beperkt tot:

b. session storage;
c. SDK’s;
d. pixels;
e. device identifiers;
f. logbestanden;
g. server-side tracking.

Deze technologieën worden hierna gezamenlijk aangeduid als “cookies”.

Resqueu kan de volgende categorieën cookies gebruiken:

Functionele cookies zijn noodzakelijk voor het correct functioneren van het Platform.

Deze cookies zorgen onder meer voor:

a. inlogfunctionaliteit;
b. sessiebeheer;
c. beveiliging;
d. fraudepreventie;
e. correcte werking van kernfunctionaliteiten.

Voor functionele cookies is geen toestemming vereist.

4. DOELEINDEN VAN COOKIES

Cookies worden gebruikt voor de volgende doeleinden:

c. analyse en verbetering van het Platform;
d. statistische doeleinden;
e. marketing en communicatie (na toestemming);
f. naleving van wettelijke verplichtingen.

5. RECHTSGRONDEN

5.1
Functionele cookies worden geplaatst op basis van gerechtvaardigd belang en wettelijke noodzaak.

Analytische cookies worden geplaatst op basis van gerechtvaardigd belang of toestemming, afhankelijk van de configuratie.

5.3
Marketing- en trackingcookies worden uitsluitend geplaatst op basis van expliciete toestemming van de gebruiker.

6. DERDEN EN COOKIES VAN DERDEN

6.1

Resqueu kan gebruikmaken van cookies en vergelijkbare technologieën die worden geplaatst of uitgelezen door derden die namens Resqueu diensten leveren.

6.2

Deze derden kunnen onder meer zijn:

a. hosting- en cloudproviders;

b. analyticsdienstverleners;

c. beveiligings- en fraudepreventiepartners;

d. marketing- en advertentiepartners;

e. technische integratiepartners.

6.3

Resqueu heeft geen volledige controle over cookies die door derden worden geplaatst en verwijst voor de verwerking van persoonsgegevens door deze partijen naar hun eigen privacy- en cookieverklaringen.

6.4

Resqueu is niet aansprakelijk voor de verwerking van persoonsgegevens door derden buiten haar directe invloedssfeer.

7. DUUR VAN COOKIES

7.1

Cookies kunnen een verschillende bewaartermijn hebben, afhankelijk van hun aard en functie.

7.2

Resqueu maakt gebruik van:

a. sessiecookies, die automatisch worden verwijderd na het sluiten van de sessie;

b. permanente cookies, die gedurende een vooraf bepaalde periode op het apparaat van de gebruiker blijven opgeslagen.

7.3

De bewaartermijnen worden beperkt tot hetgeen noodzakelijk is voor het beoogde doel.

8. TOESTEMMING, INSTELLINGEN EN INTREKKING

8.1

Voor zover wettelijk vereist wordt voorafgaande toestemming gevraagd voor het plaatsen van niet-noodzakelijke cookies.

8.2

Gebruikers kunnen hun cookie-instellingen te allen tijde aanpassen of eerder gegeven toestemming intrekken via:

a. de instellingen van de applicatie;

b. de cookie-instellingen op de website;

c. de instellingen van de gebruikte browser of het apparaat.

8.3

Het intrekken van toestemming heeft geen invloed op de rechtmatigheid van de verwerking vóór de intrekking.

9. WEIGERING OF BLOKKERING VAN COOKIES

Gebruikers kunnen cookies weigeren of blokkeren via hun browser- of apparaatinstellingen.

9.2

Het blokkeren van cookies kan ertoe leiden dat bepaalde functionaliteiten van het Platform niet of niet optimaal werken.

Resqueu is niet aansprakelijk voor gevolgen die voortvloeien uit het weigeren of blokkeren van cookies door de gebruiker.

10. BEVEILIGING EN RISICOAANVAARDING

10.1

Resqueu treft passende technische en organisatorische maatregelen ter beveiliging van cookies en daarmee verkregen gegevens.

10.2

Gebruikers erkennen en aanvaarden dat digitale opslag en gegevensoverdracht nooit volledig risicovrij zijn.

11. WIJZIGINGEN VAN HET COOKIEBELEID

11.1

Resqueu behoudt zich het recht voor dit cookiebeleid te wijzigen indien wetgeving, jurisprudentie, toezichthouders of de aard van de dienstverlening daartoe aanleiding geven.

11.2

De meest actuele versie is steeds leidend en beschikbaar via het Platform.

This cookie policy describes in a legally exhaustive and comprehensive manner how Resqueu uses cookies and similar technologies within all of Resqueu's digital environments, including but not limited to the mobile application, websites, web views, servers, and associated systems.

Resqueu's Terms of Service and EULA. In the event of any conflict, the Terms of Service shall prevail.

Resqueu does not have full control over cookies placed by third parties and refers to their own privacy and cookie statements for the processing of personal data by these parties.

Resqueu is not liable for the processing of personal data by third parties outside its direct influence.

7. DURATION OF COOKIES

7.1

Cookies may have a different retention period depending on their nature and function.

Resqueu uses:

a. session cookies, which are automatically deleted after closing the session;

b. persistent cookies, which remain stored on the user's device for a predetermined period.

Resqueu reserves the right to amend this cookie policy if legislation, case law, supervisory authorities, or the nature of the services provide warrant this.

The most current version is always authoritative and available via the Platform.
