1. ALGEMENE JURIDISCHE POSITIE EN REIKWIJDTE

Deze SOS-veiligheidsdisclaimer is van toepassing op ieder gebruik van alle door Resqueu aangeboden SOS-, veiligheids-, locatie-, waarschuwings- en noodgerelateerde functionaliteiten, ongeacht of de gebruiker handelt als consument, onderneming, medewerker, contactpersoon of derde.

Deze disclaimer vormt een integraal en aanvullend onderdeel van de servicevoorwaarden, de EULA, de privacyverklaring en het cookiebeleid van Resqueu. In geval van tegenstrijdigheid prevaleren de servicevoorwaarden.

Door gebruik te maken van enige SOS- of veiligheidsfunctionaliteit erkent en aanvaardt de gebruiker uitdrukkelijk deze disclaimer en alle daarin opgenomen beperkingen, uitsluitingen en risico’s, voor zover wettelijk toegestaan.

2. GEEN HULPDIENST, GEEN ALARMCENTRALE

Resqueu is nadrukkelijk geen alarmcentrale, meldkamer, hulpdienst, beveiligingsbedrijf, toezichthouder of vervanging van officiële noodnummers.

Het gebruik van het Platform en de daarin aangeboden SOS-functionaliteiten vervangt niet: – 112 of andere officiële noodnummers
– politie, brandweer, ambulance of medische hulp
– particuliere beveiligingsdiensten
– professionele zorg- of hulpverlening

Gebruikers blijven te allen tijde zelf verantwoordelijk voor het inschakelen van officiële hulpdiensten indien een noodsituatie dat vereist.

3. AARD EN BEPERKING VAN DE SOS-FUNCTIONALITEIT

De SOS-functionaliteit is uitsluitend bedoeld als een ondersteunend hulpmiddel om vooraf geselecteerde contactpersonen, andere gebruikers of aangesloten ondernemingen te informeren over een mogelijke noodsituatie.

Resqueu geeft uitdrukkelijk geen enkele garantie dat: – een SOS-signaal succesvol wordt verzonden
– een SOS-signaal wordt ontvangen
– meldingen tijdig worden afgeleverd
– contactpersonen beschikbaar zijn
– derden adequaat of überhaupt reageren

Technische storingen, netwerkproblemen, apparaatinstellingen, softwarefouten, updates, batterijstatus of externe factoren kunnen de werking van SOS-functionaliteiten beperken of verhinderen.

4. LOCATIEGEGEVENS EN NAUWKEURIGHEID

Locatiegegevens zijn afhankelijk van externe systemen zoals GPS, mobiele netwerken, satellieten, apparaatinstellingen en software van derden.

Resqueu garandeert niet dat locatiegegevens: – correct
– actueel
– volledig
– exact
– continu beschikbaar

zijn.

Beslissingen of handelingen die worden genomen op basis van locatiegegevens geschieden volledig voor eigen risico van de gebruiker en/of derden.

5. LOKALE WAARSCHUWINGEN EN MELDINGEN

Lokale waarschuwingen en meldingen kunnen afkomstig zijn van gebruikers, ondernemingen, geautomatiseerde systemen of derden.

Resqueu verifieert deze meldingen niet inhoudelijk en staat niet in voor de juistheid, volledigheid of betrouwbaarheid ervan.

Resqueu is niet aansprakelijk voor schade die voortvloeit uit: – het opvolgen van waarschuwingen
– het negeren van waarschuwingen
– foutieve interpretatie van waarschuwingen

6. GEDRAG VAN CONTACTPERSONEN, ONDERNEMINGEN EN DERDEN

Resqueu is niet verantwoordelijk en niet aansprakelijk voor het handelen of nalaten van:

– SOS-contactpersonen;
– andere gebruikers van het Platform;
– aangesloten ondernemingen;
– lokale helpers of “local heroes”;
– hulpverleners of derden die meldingen ontvangen.

Resqueu heeft geen invloed op de beschikbaarheid, snelheid, bereidheid, deskundigheid of adequaatheid van reacties van bovenstaande partijen. Alle gevolgen van reacties of het uitblijven daarvan komen volledig voor rekening en risico van de gebruiker.

7. UITSLUITING EN BEPERKING VAN AANSPRAKELIJKHEID

Voor zover wettelijk toegestaan is Resqueu niet aansprakelijk voor enige schade van welke aard dan ook, waaronder maar niet beperkt tot:

– lichamelijk letsel;
– overlijden;
– psychische schade;
– materiële schade;
– vermogensschade;
– indirecte schade of gevolgschade;
– gederfde winst of omzet;
– reputatieschade;
– schade als gevolg van foutieve, vertraagde of ontbrekende meldingen;
– schade als gevolg van onjuiste of onnauwkeurige locatiegegevens;
– schade als gevolg van technische storingen of systeemuitval;
– schade veroorzaakt door handelen of nalaten van derden.

Deze uitsluiting geldt ongeacht de oorzaak van de schade en ongeacht of Resqueu vooraf op de hoogte was of had kunnen zijn van de mogelijkheid van dergelijke schade.

8. RISICOAANVAARDING DOOR DE GEBRUIKER

Door gebruik te maken van de SOS- en veiligheidsfunctionaliteiten erkent en aanvaardt de gebruiker uitdrukkelijk dat hieraan inherente risico’s zijn verbonden.

De gebruiker aanvaardt deze risico’s volledig en onvoorwaardelijk en verklaart Resqueu te vrijwaren van enige aansprakelijkheid, voor zover wettelijk toegestaan.

Ouders zijn volledig verantwoordelijk voor instellingen en toezicht.

9. OVERMACHT

Resqueu is niet aansprakelijk voor enige tekortkoming of schade indien deze het gevolg is van overmacht in de zin van artikel 6:75 BW.

Onder overmacht wordt onder meer verstaan, maar niet beperkt tot:

– storingen in (tele)communicatienetwerken;
– elektriciteitsuitval;
– cyberincidenten of hacking;
– software- of hardwarefalen van derden;
– overheidsmaatregelen;
– natuurrampen;
– pandemieën;
– andere omstandigheden buiten de redelijke invloedssfeer van Resqueu.

10. SLOTBEPALINGEN

Indien enige bepaling van deze SOS-veiligheidsdisclaimer nietig of vernietigbaar blijkt, blijven de overige bepalingen volledig van kracht.

Resqueu behoudt zich het recht voor deze disclaimer te allen tijde te wijzigen. De meest actuele versie is steeds leidend.

Deze SOS-veiligheidsdisclaimer maakt integraal onderdeel uit van de juridische documentatie van Resqueu en is bindend voor alle gebruikers.

 1. GENERAL LEGAL POSITION AND SCOPE

This SOS safety disclaimer applies to any use of all SOS, safety, location, warning and emergency-related functionalities offered by Resqueu, regardless of whether the user acts as a consumer, business, employee, contact person or third party.

This disclaimer forms an integral and supplementary part of the terms of service, the EULA, the privacy policy and the cookie policy of Resqueu. In the event of conflict, the terms of service shall prevail.

By making use of any SOS or safety functionality, the user expressly acknowledges and accepts this disclaimer and all limitations, exclusions and risks contained herein, to the extent permitted by law.

 2. NOT AN EMERGENCY SERVICE, NOT AN ALARM CENTRE

Resqueu is expressly not an alarm centre, dispatch centre, emergency service, security company, supervisory authority or replacement for official emergency numbers.

The use of the Platform and the SOS functionalities offered therein does not replace:

- 112 or other official emergency numbers

- police, fire brigade, ambulance or medical assistance

- private security services

- professional care or emergency services

Users remain at all times personally responsible for contacting official emergency services where an emergency situation requires it.

 3. NATURE AND LIMITATIONS OF THE SOS FUNCTIONALITY

The SOS functionality is intended solely as a supportive tool to inform pre-selected contact persons, other users or affiliated businesses of a possible emergency situation.

Resqueu expressly gives no guarantee whatsoever that:

- an SOS signal is successfully transmitted

- an SOS signal is received

- notifications are delivered in a timely manner

- contact persons are available

- third parties respond adequately or at all

Technical failures, network issues, device settings, software errors, updates, battery status or external factors may limit or prevent the operation of SOS functionalities.

 4. LOCATION DATA AND ACCURACY

Location data depends on external systems such as GPS, mobile networks, satellites, device settings and third-party software.

Resqueu does not guarantee that location data is:

- correct

- current

- complete

- exact

- continuously available

Decisions or actions taken on the basis of location data are entirely at the risk of the user and/or third parties.

 5. LOCAL WARNINGS AND NOTIFICATIONS

Local warnings and notifications may originate from users, businesses, automated systems or third parties.

Resqueu does not verify these notifications as to their substance and does not guarantee their accuracy, completeness or reliability.

Resqueu is not liable for damage resulting from:

- acting upon warnings

- disregarding warnings

- incorrect interpretation of warnings

 6. CONDUCT OF CONTACT PERSONS, BUSINESSES AND THIRD PARTIES

Resqueu is not responsible and not liable for the actions or omissions of:

- SOS contact persons;

- other users of the Platform;

- affiliated businesses;

- local helpers or "local heroes";

- emergency responders or third parties who receive notifications.

Resqueu has no influence over the availability, speed, willingness, expertise or adequacy of responses from the above parties. All consequences of responses or the absence thereof are entirely at the risk of the user.

 7. EXCLUSION AND LIMITATION OF LIABILITY

To the extent permitted by law, Resqueu is not liable for any damage of whatever nature, including but not limited to:

- personal injury;

- death;

- psychological damage;

- material damage;

- financial damage;

- indirect damage or consequential damage;

- loss of profit or revenue;

- reputational damage;

- damage resulting from incorrect, delayed or missing notifications;

- damage resulting from inaccurate or imprecise location data;

- damage resulting from technical failures or system outages;

- damage caused by the actions or omissions of third parties.

This exclusion applies regardless of the cause of the damage and regardless of whether Resqueu was or could have been aware in advance of the possibility of such damage.

 8. ACCEPTANCE OF RISK BY THE USER

By making use of the SOS and safety functionalities, the user expressly acknowledges and accepts that these carry inherent risks.

The user accepts these risks fully and unconditionally and declares to indemnify Resqueu against any liability, to the extent permitted by law.

Parents are fully responsible for settings and supervision.

 9. FORCE MAJEURE

Resqueu is not liable for any failure or damage where this is the result of force majeure within the meaning of Article 6:75 of the Dutch Civil Code.

Force majeure includes, among other things, but is not limited to:

- failures in (tele)communications networks;

- power outages;

- cyber incidents or hacking;

- software or hardware failures of third parties;

- government measures;

- natural disasters;

- pandemics;

- other circumstances beyond Resqueu's reasonable sphere of influence.

 10. FINAL PROVISIONS

If any provision of this SOS safety disclaimer proves to be void or voidable, the remaining provisions shall remain fully in force.

Resqueu reserves the right to amend this disclaimer at any time. The most current version shall always prevail.

This SOS safety disclaimer forms an integral part of Resqueu's legal documentation and is binding on all users.
